Introduction

Sanlam Credit Solutions provides you with free access to your credit report and credit score. These Terms and Conditions set out the terms of the agreement between you and us (“the Agreement”) under which we will provide you with access to the information and services we offer from time to time via the Sanlam Credit Solutions website located at www.sanlamcredit solutions.co.za (the Website). It is, therefore, in your interests to read them carefully.

References in these Terms and Conditions and on our website to “we”, “our” or “us” are references to Sanlam Credit Solutions and/or (where the context permits) our third party service providers together with their subcontractors. References to “you” and “your” mean each natural or legal person who uses our website or the associated services.Sanlam Credit Solutions is a business unit of Sanlam Life Insurance Limited and operated by New IDM Holdings (RF) (Pty) Ltd.

Acceptance

By accessing or using the Sanlam Credit Solutions Website these Terms and Conditions apply to you and you agree to comply with the Terms and Conditions. Should you not want to be legally bound to the following Terms and Conditions you have the option to not accept them, in which case you will be unable to use our Website and Services. Please check the Website regularly for changes to the Terms and Conditions. The Terms and Conditions may change from time to time and the terms displayed at the time that you use the Website will govern your use of the Website.

Registering to use our Website and our Services

Before you can use our services you must register through our website. During this process you have the opportunity to access, review and receive a copy of these Terms and Conditions, including our Privacy Policy, and by registering for an account you confirm your acceptance of them.

Presenting a credit report and credit score is subject to you passing appropriate identity authentication for security purposes. Not all users will successfully pass the identity authentication process. If you fail the process, you agree that we do not have to notify you of the reasons why you failed. When you register for our services by accepting these Terms, we may request personal details to verify your identity. We will use these details for the purposes of verifying your identity (and to prevent, detect and prosecute fraud and crime and comply with legal or regulatory requirements).

After you register with us, we will take you through an ID validation process to securely identify you as an individual with a credit report. Once your identity has been validated, we will then provide you with a copy of your credit report and credit score.

Sanlam Credit Solutions Services

On your acceptance of these Terms and Conditions, and our acceptance of your duly completed registration application, you engage us as a service provider to provide you with the following Services:

  1. obtaining on a monthly basis on your behalf, as your authorised agent and representative, copies of your credit report and credit score from a designated credit bureau registered as such with the National Credit Regulator (“NCR”) in terms of the National Credit Act 34 of 2005 (NCA). Please note that all costs for the retrieval and presentation of the credit report and credit score are paid for by us;
  2. obtaining updated transactional information from your bank. Once you have linked your bank accounts on your Sanlam Credit Solution dashboard, your bank details will be stored on our secure platform. Your bank details will never be used for any other purpose than providing you with an updated full view of your financial position, stating both income and expenses. You can delink your bank accounts on the Sanlam Credit Solutions platform at any time.
  3. once we are satisfied that all the requirements have been fulfilled, we will then provide you with a copy of your credit report and credit score;
  4. provided you remain an active user of our services, we will obtain an updated copy of your credit report and credit score on a monthly basis and alert you by email that a new report is available;
  5. if there has been a significant change or addition to information in your credit score or credit report, we may notify you of that change by sending you an email alert;
  6. performing analysis and profiling of your and, where applicable, your financial associates’ (meaning any person with whom you have a joint financial account or mortgage, have made a joint credit application or have a joint court judgment) credit information (and any other information provided by you or on your behalf) and/or to make tools available to you to do so yourself, to assist you in being better informed about, understand and manage your credit position, and in order to identify and inform you of credit products (including but not limited to personal loans and credit cards) that are likely to be suited to your credit circumstances; and
  7. this service is not regulated under the Financial Advisory and Intermediary Services Act 37 of 2002 (“the Act”) and therefore is not afforded the same protection that may apply to the provision of the financial products or services regulated under the Act like, for instance Credit Life Insurance.
  8. access to debt management services in relation to clients who may be over-indebted or struggling with debt.

Certain parts of our Services are supplied to us by our third party service providers such as credit bureaux. To undertake identification validation and to provide our services we need to share information collected from you with our service providers, as further detailed in our Privacy Policy.

We will use third party service providers to identify and provide you with information of credit products that we consider are relevant to your credit rating. We aim to present only the economically advantageous products that you have a strong likelihood of being accepted for based on the merits of the product and your profile. Any credit product recommended or suggested to you will be supplied by a credit provider that is registered as such with the NCR in terms of the NCA.

We do not charge you for the use of our website or our services. However, we may receive a fee if you purchase a product from a provider or issuer of credit whose information, we have provided to you through advertising on our website or otherwise. Where possible and applicable we will provide a description of the basis of the fee that we earn with each product offer on our website.

Any information provided to you as part of our services is only as accurate, complete and up to date as the information supplied to us by the credit bureau or other third party we use to obtain this information. You understand and acknowledge that we do not check the information we receive from third parties for accuracy or completeness and that there may be instances where such information proves inaccurate or incomplete. We do not assume responsibility for the timeliness, accuracy, deletion, non-delivery or failure to store any user information, communications or personalisation settings.

If you have a query or dispute in respect of the Services, please contact us directly using the details provided in the section Contact Us below. If the query or dispute relates to any information we have obtained from a credit bureau or third party service provider, you acknowledge and understand that we may refer the query or dispute to them if we deem appropriate and you authorise us to do so.

By using our services, your records and, where applicable, those of your financial associates will be searched. Searches are carried out as follows:

  1. as part of verifying your identity, we will carry out an authentication search against your credit information. This search will be carried out once at the time you register for our Services;
  2. whilst you remain an active user of our services, we will carry out searches against your credit information on a monthly basis in order to provide you with your credit score and credit report; and
  3. we may share your information with third party service providers, such as credit bureaux, financial services providers and other advertisers, in accordance with our Privacy Policy and your account’s privacy settings.  Certain third party product and services providers may provide us with their own services to assess your suitability for particular products. 

If you would prefer not to share your information with such third party service providers, you can opt out of this at any time under your account preferences, by turning off “Change whether or not we can use quotation searches” in the “ My Account” section.  If you do opt out of this, we will not be able to show you products that are specifically targeted to you and will only be able to show you generic advertisements which may be less suited to your financial circumstances.

The credit bureau will keep a record of each search and place a “footprint” on your credit file. The types of footprints our searches leave do not impact on your credit rating. They will not be seen by banks and issuers or providers of credit when you apply for their products and are removed from your credit file after a year. They are often referred to on your credit report as Quotation searches for example as ‘personal loan quotation’ or ‘credit card quotation’.

If you choose to apply for a credit product from a product provider by visiting their site either independently or via our website they may undertake a credit check that may leave a “footprint” on your credit report. They may also provide you with the terms & conditions for that product which you understand and acknowledge are not related to our terms & conditions. You understand and acknowledge that your application for a credit product displayed by us is entirely between you and the relevant credit provider and that your eligibility for that product will at all times be subject to the relevant provider’s terms and conditions and to all requirements imposed in terms of the NCA (including but not limited to the carrying out by the relevant credit provider of an appropriate affordability assessment).

Accessing our website and our services

You must be at least 18 years of age and a resident in South Africa to use our website and any services provided through it.  You warrant to us (ie promise in a way that you can be held legally bound by that promise) that you have the required legal and contractual capacity to enter into and be bound by contractual terms.

You may access and use our website and our services only for your personal use on your own behalf and not on behalf of anyone else. You must not engage another person, company, partnership or other entity to access our website or our services on your behalf. You must not order, or attempt to order, credit information about anyone else through our website.

Whilst we try to keep any disruption to our website and Services to a minimum, our website and Services may become unavailable from time to time in order for us to carry out planned and unplanned maintenance and security updates. In the case of planned maintenance, we will use our reasonable best efforts, where possible, to provide you with some notice of our intention to suspend the website or the services before we do so.

Use of the Website Policy

You agree to use the Website for lawful purposes only. If you should choose to access or use this Website from locations other than the Republic of South Africa, you do so at your own initiative and you are responsible for compliance with the applicable local laws.

You are prohibited from posting or transmitting, by means of reviews, comments, suggestions, ideas, questions or other information through the Website, any content which is, unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually-explicit, profane or hateful, or racially, ethnically or otherwise objectionable content of any kind, which includes but is not limited to:

We may from time to time provide interactive services on our website, including, for example, for you to review and comment on the services and products that we or product providers or issuers of credit provide.

Content Standards

These content standards apply to any and all material which you contribute to our website and to any interactive services associated with it.

Whist every attempt is taken by Sanlam Credit Solutions to ensure your security when making use of the Website, due to the nature of the Internet we are unable to guarantee that any products and services or any websites accessible via the Website are Virus- or error-free. We therefore caution you to check all emails, attachments and files before downloading them.

We may provide links to other websites or resources. We are unable to accept, and do not accept, responsibility for these websites or resources; nor have we endorsed their content, products or services merely because they are accessible via the Website. The linked websites and resources are governed by their own terms and conditions. It is your responsibility to check the terms and conditions of any other linked website or resource you may visit. Your use of the products or services made available through linked websites and resources is done so at entirely your own risk.

Those products are governed by separate terms and conditions of supply and to extensive requirements in terms of the NCA. You agree that we are not responsible or liable for any loss or damage you may suffer or incur in connection with any such product, or the terms and conditions applying to any contract (credit agreement) you enter into with any third party in relation to any product, or for any acts, omissions, errors or defaults of any third party in connection with any product or the applicable terms and conditions.

We do not charge you any fee for access to and use of our website or our services. On this basis our total aggregate liability for any losses and/or damage suffered by you will be limited, to the fullest extent permitted by applicable law, to R1,000.

While we take all reasonable steps to safeguard the security of any information you input or send to us in connection with the Sanlam Credit Solutions Service, by using secure services and encryption technology where we deem appropriate, we accept no responsibility or liability whatsoever for any damages that you may suffer as a result of the breach of confidentiality of such information.

Our Liability to you

We shall not be liable to you in contract, delict (including for negligence) or otherwise:

  • for any amount in respect of any damage or loss arising from the consequences of your use of the Website, viruses received by you via the Website or of our failure to provide the Website in accordance with this Agreement;
  • for any economic losses, any direct, special or consequential loss, loss of data, goodwill or reputation or any wasted expenditure including but not limited to losses caused by your use of the Website or through any viruses; or
  • for any failure to perform our obligations or failure to perform our obligations properly as a result of our being prevented from doing so by an event beyond our reasonable control (which may include, without limitation, strikes; labour disputes; acts of God; war; riot; civil action; malicious acts or damage; compliance with any law, governmental or regulatory order, rule, regulation or direction; any act or omission of any government or other competent authority; accident; equipment or services failure, including unavailability of third party telecommunications services, lines or other equipment; fire; flood or storm).

Security

By submitting Content you confirm and agree that the owner of that Content has expressly agreed that, without any particular time limit, and without the payment of any fees, we may use the Content for the purposes set out in these Terms.

Duration of our services and termination of this agreement

Sanlam Credit Solutions reserves the right to-

  • monitor and log user activity, and any material contributed by users, for security purposes and in order to identify any actual or potential misuse of our website or our services;
  • refuse you further access to the website if
    (a) you breach any of the terms of use applicable from time to time;
    (b) Sanlam Credit Solutions is unable to verify or authenticate any information you provide to it;
    (c) Sanlam Credit Solutions believes that you are conducting activities that are illegal, abusive, threaten the integrity of the website, or may place Sanlam Credit Solutions in disrepute;
  • refer any breach to the police if such breach constitute a crime; and
  • claim damages for all loss and damage it suffers, and expenses it incurs, as a result of your breach.

If you no longer wish to receive our services you can close and delete your account by visiting the ‘My Account’ section and clicking on ‘Delete Account’. Please note that once deleted, your account cannot be recovered and you will not be able to access the credit or other information we hold about you through our website.

Please note that if you withdraw consent to the processing of your personal data, access to our website and the services will be suspended or terminated. We will keep an archived record of your personal data for a period of up to 7 years after termination (unless a longer period is prescribed by law) for the purposes of responding to legal disputes and legal or regulatory enquiries or investigations only, but will not use this data for any other purpose.

No reliance on information

The content on our website and any information provided to you as part of our services is provided for general information only. It is not intended to amount to advice on which you should rely. We do not control your credit score or credit report and we cannot change that information for you.

Businesses that carry out credit searches on you collect and maintain information about you from a number of sources, including but not limited to credit providers and banks (including details of previous credit applications and the conduct of your bank accounts) and publicly available sources like court judgments. They may also form a link between any previous or subsequent names that you use in the records they hold about you.

Such businesses will use their own criteria in making decisions about you. Any decisions you make on the basis of your credit score or credit report, or any other information we provide or make available to you, are purely your own choice.

Please therefore ensure that you have fully read and understand any relevant information, such as the credit provider’s terms and conditions, which provide full details of the risks involved with any decision you make and full details of the costs involved in binding yourself to and under a credit agreement. You may wish to consider obtaining professional or specialist advice before taking, or refraining from taking, any action on the basis of the content on our website or any other information we provide or make available to you.

This Privacy Policy and Cookies Policy only covers Sanlam Credit Solutions Website at www.sanlamcreditsolutions.co.za/privacy , and forms part of the Terms and Conditions of the Agreement By using our website or our services you consent and agree to the processing of your personal information and our use of cookies in accordance with those policies.

Linked websites are governed by their respective privacy statements. We are not responsible for the data policies or procedures or the content of other linked websites.

Competition Terms and Conditions

  1. All competitions (“Competition”) are conducted by Sanlam Credit Solutions (a division of Sanlam Life Insurance Limited), a company incorporated and operating under the laws of South Africa, with registered offices at 2 Strand Road, Bellville, Cape Town, 7530, South Africa (Company Registration No: 1998/021121/006) (hereinafter referred to as (“Promoter”).
  2. The Competition is open to SA residents only and all active users on the Sanlam Credit Solutions platform may be required to show valid identity documents as proof thereof.
  3. The Competition duration period will clearly be stipulated in email and/or SMS marketing messages.
  4. To enter, participants must use the entry mechanism specified on the email and/or SMS noting the terms and conditions of the Competition.
  5. Participation by the entrants in the Competition constitutes an agreement to abide by these Rules. Any person failing to comply with these Rules will not be entitled to participate in the Competition or will be disqualified from the Competition.
  6. Where there is ONE or MORE winners, winners will be drawn at random at the close of the Competition and will be contacted via SMS, CALL and/or EMAIL once the competition has closed. To announce the winners, a pop-up notification and/or banner, listing the winners' full names, may be visible on the Sanlam Credit Solutions platform for a specific date range determined by the Promotor.
  7. Should the winner/s not be available within four weeks after the announcement of the winner/s, and after an attempt to connect with the winner/s, the winner/s will forfeit the prize/s.
  8. The prize/s is not transferable, is non-refundable, non-exchangeable and cannot be redeemed for cash. To the maximum extent permitted in law, the Promoter excludes liability for any defects in the prize.
  9. The prize/s selected by the Promotor for each participant remains at the discretion of the Promoter.
  10. Sanlam Credit Solutions' decision is final, and no correspondence will be entered into.
  11. The Promoter reserves the right to terminate or temporarily suspend a Competition in the event of technical or other difficulties that might compromise its integrity.
  12. The Promoter accepts no responsibility for difficulties experienced in submitting an entry to any Competition hosted by the Promotor.
  13. Unless otherwise advised, the prize/s will be distributed via SMS and/or EMAIL to the number/email used to sign up to the Sanlam Credit Solutions platform. If the number or email is no longer in existence or the mobile is powered off/email account deactivated, the Promotor accepts no responsibility for the winner/s not receiving the prize.
  14. To the maximum extent permitted in law, the Promoter and its directors, officers, managers, employees and agents, shall not incur any liability to any person for any injury, claim, loss or damage of any nature whatsoever, whether direct, indirect, consequential or otherwise, as a result of entering into, or arising from any cause whatsoever or howsoever arising from their participation in Competition or the use of any prize won thereunder (any such prizes being utilised at the own risk of any winner thereof).
  15. In the event of a dispute in respect of any aspect of the Competition, the Promoter's decision is final, and no correspondence will be entered into.
  16. By entering a Competition, you agree to receive further communication and direct marketing material from the Promoter.
  17. Participants understand and agree that in order for the Promoter to offer the Competition, the Promoter must collect and use personal information about the participants.
  18. This Competition shall comply with, and will be subject to, any peremptory provisions of the Consumer Protection Act 68 of 2008 (“CPA”) and the regulations promulgated thereunder, which are deemed to be incorporated herein (“Peremptory Provisions”). In the event of any conflict between these Rules and the Peremptory Provisions, the latter shall prevail. Copies of the CPA and the regulations promulgated thereunder are available on the Department of Trade and Industry website: www.thedtic.gov.za.
  19. Any provision of these Rules or the Competition which is held to be invalid or unenforceable shall be ineffective to the extent of such invalidity or unenforceability without invalidating or rendering unenforceable the remaining provisions thereof.
  20. The laws of the Republic of South Africa govern these Rules and participants agree to be subject to the exclusive jurisdiction of the South African courts.

Governing Law and Jurisdiction

This Agreement shall be governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the Cape Town High Court in the event of any dispute arising from this Agreement. If any of the provisions of this Agreement are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of this Agreement, and the remainder of the Agreement shall continue in full force and effect. This Agreement constitutes the entire agreement between you and us with regard to the use of the Website.
